Unlike what the page says, it's not purchasable worldwide on Steam. I have the notice: "This item is currently unavailable in your region", and my "region" is France.

Strangely, I can purchase the first Max Payne but with only the French language.

Is the version of EAX 2.0 or 3.0?

The game claims that the version is 2, however the dll file's version is 3.0.

eax.dll in the game has version 3.0.1.0. Maybe on previous stages of development they supported 2.0 hence the mistake in game text in launcher menu you talk about. Similarly, like in the previous installment which initially supported Glide, but it was dropped. BTW. The good place to compare it with 4.0 dll, to see how various libraries affect the sound is in "In The Middle of Something" where you enter to the large hall with stairs when two NPCs above start talking. https://www.dllme.com/dll/files/eax

The -nodialog key works for me with the Steam version, but it causes the game to ignore the graphics settings made in that dialog. Either the default or the lowest settings are probably used instead then. At least all the world textures were displayed in 16 bit depth for me.

Game seemingly has native support of 120 fps.

Unlike most games where physics can break over 60 fps in significant and detrimental ways, it seems to have an extremely minor effect in this game. The physics are slightly off but it only amounts to minor visual glitches with physics objects jumping around slightly (nowhere near like Skyrim, for example) on occasion and does not impact gameplay. At worst, an NPC late in the game can get stuck in a door but it is easily fixed by opening the door the other way.

Currently the only source for major physics issues is a GitHub issue report that isn't very detailed and could easily be a matter of preference.

Am I the only one getting this or is it really capped cuz i got a 60 hz montier cuz i am maxing it out 1080p but i also don't have vsync on can anyone confirm its capped at 60 fps or not??? I mean have no problem being it capped at 60 fps just wondering if it is or not.

The game just has Vsync enabled, so it's capping at your monitor's refresh rate. If you disable Vsync in your driver (on Nvidia it would look like this) the frame rate should go well above 60 FPS.

Oh thanks but i am useing amd but i'll check the amd catlyest control panel and see if that fixs it or not thanks for the help.
